The Clinton City Council will consider a settlement in a legal dispute with a female firefighter over the city’s actions when she was pregnant.

Karen McQuistion filed the legal action against the city because she was not allowed light duty while pregnant claiming that was discrimination.

The legal action has been heard in district court, the appeals court and then in the latest hearing the Iowa Supreme Court.  The state’s high court supported some of the previous rulings in favor of the city –  but sent the case back to lower court for further review of other segments.

The settlement dismisses all claims and legal action.

McQuistion would be paid 25-thousand dollars plus attorney fees of 80-thousand dollars and litigation expenses of six-thousand dollars.  The city would $1,000 and the remainder would be paid by under the city’s insurance carrier.

The settlement states that it is the intention of the parties to end any dispute. The release concludes that the settlement should not be seen in favor of either party. (pages 93-97 in the agenda linked at the bottom of this story) the resolution to approve the settlement is on the agenda for the Clinton city council meeting Tuesday night.

There is also a potential closed session for legal matters.

City legal counsel Patrick Connell tells KROS via email question that the topic involves a possible collection issue-where the city may be owed some money and may have a claim.  a brief general topic of such closed may be made public.

the council meets at 7 p-m Tuesday.

There will also be a committee of the whole session.
