City responds to court judgment
(Clinton) -- Brief statement is issued from City Hall on the verdict that a closed meeting was illegal.
(see earlier posted story for details)
City leaders have issued a short response to the recent judgment they held an illegal closed door session. The original lawsuit was filed by former Human Resource Director Dave Geisler. That suit alleged there were two improper closed sessions.
A court judgment ruled a September 13, 2011 meeting was illegal because it was held to discuss budget reductions and not an individual.
Mayor Mark Vulich issued the brief statement this morning that said - The City has received the Ruling on Plaintiff’s Summary Judgment Motion. Because this is still pending litigation the City will not comment on the decision other than to say all legal options are being investigated with regard to the ruling including appeal to the Iowa Supreme Court.
A second meeting cited the suit-on September 2nd, 2011 is still has facts in dispute and a hearing will be held on that portion of the suite. The penalties for the first cited violation would be discussed at that time.
Penalties can range from fines against the council members and city to a promise not to violate the law again. You can see more on the law and penalty sections in links provided on our webpage krosradio-dot-com or on our Facebook page.
