Public Hearing Concerning the Proposed Amendment to the Zoning Regulations Postponed

The City of Clinton is postponing tonight’s scheduled public hearing regarding the proposed data center zoning ordinance.

The City provided notice of the public hearing in accordance with the applicable requirements of Iowa state law. However, in preparing for tonight’s hearing, the City identified a provision within the City’s zoning regulations that references a seven-day notice requirement for certain zoning-related public hearings.

The language of that provision is somewhat unclear as to the specific types of zoning actions or amendments to which the seven-day requirement applies. The City is therefore not making a determination at this time that the provision applies to the proposed data center ordinance.

Out of an abundance of caution, the City has decided to postpone tonight’s public hearing and provide additional notice before rescheduling the hearing. This approach will ensure that the City exceeds the applicable notice requirements and provides the public with additional time and opportunity to review the proposed ordinance and participate in the public hearing process.

A new date and time for the public hearing will be established, and a new public notice will be published in advance of the hearing.

The Special Council meeting will proceed as scheduled, as the agenda includes an additional item unrelated to the data center ordinance.
